PA Filial Law this is scary

I just found out about Pennsylvania's Filial Responsibility Law today, and to be honest, I'm feeling pretty shaken up.

I always thought that having long-term care insurance (I've got four years covered) would be enough to shield both me and my family. But now I'm learning that adult children might actually be held financially responsible for their parents' or even grandparents' nursing home costs if they can't pay?

This is completely new to me, and honestly, a bit terrifying. My grandmother lived past 100, and while I definitely believe in planning ahead, this is such a big unknown that I never considered in my retirement or estate planning.

Has anyone else looked into this law or had to deal with it personally? Does LTC insurance truly protect you, or are there still risks for family members to worry about?

I would really appreciate any insights, resources, or personal stories you might have.

Pennsylvania's Filial Responsibility Law is definitely a curveball and I think there have been successful lawsuits against adult children in PA!
However, your four years of LTC insurance is excellent foresight and a strong protective measure.
It significantly mitigates the risk because its primary goal is to cover your care costs, preventing you from becoming indigent.
If your policy pays, the nursing home has no reason to pursue your family under filial laws.
You might be able to find elder law attorneys in your area who specialize in this and book a consultation to review your specific situation and LTC policy.
 
Yeah, PA's filial law is real, but it doesn't get enforced often unless there's no insurance, no Medicaid, and unpaid nursing home bills. Your LTC coverage definitely helps and it's designed to keep exactly that situation from happening
 
Filial responsibility laws are a legal time bomb, most people ignore them until it's too late. Four years of LTC coverage won't matter if costs outlast it...families can still get dragged into crushing debt
